Our Process
- Pre-Litigation & Demand: The aggrieved party issues a formal Letter of Demand giving the opponent a specific timeline (usually 7 to 14 days) to settle the claim before court action.
- Pleadings (Filing the Suit):
- The Plaintiff files a Plaint, Verifying Affidavit, and supporting documents.
- The Defendant is served and must file a Memorandum of Appearance and a Defence within 14 days of service.
- Pre-Trial Conference: Parties attend a mandatory court-guided session to narrow down issues, check if all documents are exchanged, and explore if Court-Annexed Mediation is possible.
- Hearing: Both sides present their cases, call witnesses, examine evidence, and undergo cross-examination before the judge.
- Judgment & Execution: The Court delivers its final verdict. The winning party can execute the decree (e.g., through auctioneers or property attachments) if the losing party does not file an appeal.
- Notice of Arbitration: A party triggers arbitration by serving a formal notice based on the Arbitration Clause in their contract.
- Appointment of Arbitrator: Parties mutually agree on a sole arbitrator or a panel. If they disagree, an appointing authority (like the Chartered Institute of Arbitrators – CIArb Kenya) selects one.
- Preliminary Meeting: The arbitrator meets with both legal teams to set procedural rules, timelines for filing statements, and hearing dates.
- Submission of Statements: Parties exchange their Statement of Claim and Statement of Defence along with witness statements.
- Arbitral Hearing & Award: The arbitrator conducts a private hearing and issues a final, legally binding Arbitral Award which can be registered in the High Court for enforcement.
